DESCRIPTION:September 11\, 2024 – March 20\, 2025\n\n\n\nSchools are dealing with increasingly complex matters pertaining to students’ mental health and social/emotional well-being. SUMMARY:IPLSA- Sullivan v. Kanable and Boundary Mediation
DESCRIPTION:This seminar is a two-part event. \nPart one will be a discussion of Sullivan v. Kanable\, a 2015 Lake County Appellate Court case involving a boundary dispute. This case was discussed in Dick Bales “Red” book on Illinois Law. This seminar will delve deeper into the case and how both surveyors could have better presented their case. The court also badly misunderstood the facts of the case and appears to have failed to render a clear opinion. We will examine the facts and what the court said. \nPart two will discuss Boundary Mediation. We will discuss the causes of uncertainty in boundary location and retracement\, and one possible solution to going to court to resolve that uncertainty. Boundary mediation can be done by anyone skilled in the process of getting two parties with differing opinions to agree. It is not the practice of law because the mediator is not advising either party. A surveyor may be best equipped to mediate an uncertain boundary because a surveyor understands the facts and the law that make it uncertain.
